Challenge a Fixed Penalty Notice

FPN is an invitation for you to discharge your liability to prosecution. In essence this means that whilst this is not an admission of your guilt, you do admit that an offence has been committed and that by paying the sum of money specified, no further action will be taken by, or on behalf of the council.

If you wish to dispute that you or your business is liable for an offence, this form provides you with an opportunity to respond to the allegation(s) in an interview under caution. This form constitutes an online interview and is in accordance with the Police and Criminal Evidence Act 1984 and the relevant associated Codes of Practice. This is an investigation and may lead to formal legal proceedings in respect of the offence(s) listed above. You are required to respond to each of the interview questions.

You are reminded you have the right to seek legal advice before answering any questions.

This is a criminal matter and details of the maximum penalty which can be imposed, following conviction of offences under the Environmental Protection Act 1990, are provided in Part A of the Fixed Penalty Notice.

Following receipt of your response, a full review will be undertaken, and you will be notified of the Council's decision in writing

Please confirm that you understand that any responses given are being made under caution and may be used in evidence. Further, that answers provided are not under duress and are correct to the best of your knowledge and belief.
